They are illegal if you do not own the original cartridge, and the ROM itself is of a copyrighted game.

Home brews and Public Domain roms created for emulators are (of course) 100% legal since they're free.

There are a couple of MAME romsets that are freely available. one I don't remember the name of was some weird game, and the other was 'Robby Roto' where the original creator released the rights to it so now you can go online and download it for free if you like. I don't know if either of them are any good, but at least you wouldn't be "breaking the law" :P

The rundown...

Emulators are always legal (regardless of what the Big 3 may say) unless it's a commercial one and you obtained it via "questionable" means.
ROMs are legal only if they are in the public domain. If you see a ROM of the latest [insert crappy commercial game here], odds are it's illegal to have unless you dumped said ROM image yourself.
BIOS images fall under the same rundown as ROMs.

There's way more but my brain won't let me go any further tonight.

Speaking of public domain ROMs, head over to PDRoms to find a LOT of good & freely-available ROMs, including a few things created by myself (under the GB, GBC & GBA sections).
